“Liability Issues in Private Security”

Peter G. Skiko -

Pete Skiko is an ASIS member and equity partner at downtown Chicago litigation firm Swanson, Martin & Bell. Pete has been a Chicago trial lawyer for 20 years, and specializes in representing security services providers who are sued over allegations of excessive force, failure to prevent third-party criminal acts and other negligence that leads to personal injury or property damage. Pete is currently defending the security service whose guard was taken hostage during the triple-homicide at 500 West Madison in December of 2006, and has successfully defended security service providers in contract, tort and insurance coverage disputes for many years. Pete also handles other high-profile catastrophic loss cases, including the defense of building owner Cook County in the litigation stemming from the County Building high-rise fire that claimed six lives in October of 2003. Pete will discuss actual shooting death and other third-party criminal cases where the security provider's contract language was critical to the judge's decision to dismiss the security provider and the company that hired the security provider or to allow the case to go to a jury.

Pete will be also speaking about legal issues facing both contract and proprietary security providers, including:

· Factors that will determine whether a contract security provider can be held liable for failing to safeguard against the criminal acts of others.

· How security contractors can significantly impact the extent of their potential liability simply by drafting their contracts a certain way - or asking/insisting that certain language be added or removed from their clients' contracts.

· How business owners can avoid liability for negligent hiring, retention and training of their guards.
